Benefits available in California. California’s no-fault workers’ compensation system means you generally do not have to prove your employer was at fault to receive benefits. Depending on the injury, benefits can include medical treatment for the work injury, temporary disability payments while you recover, permanent disability benefits, supplemental job displacement (retraining) vouchers, and, in the most serious cases, death benefits for dependents.

Protecting your claim. Report the injury to your employer promptly and in writing, get medical care, and keep copies of claim forms and correspondence. Deadlines apply to both reporting and filing, and missing them can cost you benefits. If your claim is denied or your treatment is cut off, that decision can be challenged before the Workers’ Compensation Appeals Board.

Do I have to prove my employer did something wrong? No. Workers’ compensation is generally a no-fault system — you can receive benefits for a work-related injury regardless of fault.

My claim was denied. Is that the end? No. Denials can be challenged, and many are resolved in the worker’s favor once the medical evidence and record are properly presented.
